Summary Administration Timeline

  • Week 1: File petition with probate court
  • Weeks 2-3: Serve notice on heirs and creditors
  • Weeks 3-8: Court reviews and approves (judge can act quickly with summary administration)
  • Weeks 8-12: Distribute assets; close estate
  • Total: 2 to 4 months

Key Deadlines

File immediately: No waiting period in Florida. File the petition anytime after death.

Serve notice within 5 days: Notice must be served on heirs and creditors within 5 days of filing.

Creditors have 3 months: From the date the notice is first published, creditors generally have 3 months to file claims.

Close estate: After creditor deadline and distributions, petition to close. Judge can approve quickly.

Full Probate (If Estate Exceeds $150,000 or Includes Real Property)

  • Filing to appointment: 4 to 8 weeks
  • Creditor claim period: Generally 3 months from the date notice is first published
